There is currently a HUGE debate going on on RPOL.net as regards a paid access section to the "adult" games...it's all very shouty and flamy with a lot of people talking utter BS and not reading each others' post properly.
However, one of the side threads that it spawned produced this little gem which I just had to share:

Isn't it more to do with requesting permission from a person to use thier image, and perhaps paying royalties for doing so?

I know that's one way to do it. I don't know about Jaguar said. I know with written materials, it's far, far less than 30%. Closer to 5%. And even then, a picture made of a character can be illegal (any fanart, free or otherwise, made of the characters from an Anne McCarthy (or whatever her name is) book or story is illegal, because she has made it so.)

2) Taking the McCaffery example, a picture made of one of her characters as fanart only counts as illegal if McCaffery, as the copyright holder, chooses to press charges. Real example, kids writing Harry Potter fanfics and posting them online were threatened with legal action by Scholastic Books within the last 2-3 years. J.K. Rowling, who owns the copyright to the charaters etc., shut down the lawsuit because she saw no reason to indict anyone (the publisher made the threat without her knowledge), and in fact encouraged the kids to write more.
